These Terms & Conditions govern your use of culturenest.in and any purchase you make from Culture Nest. By using this website or placing an order, you accept these Terms.

Eligibility

You must be at least 18 years old and legally capable of entering a contract under the Indian Contract Act, 1872. If you're under 18, you may use this site only with the involvement of a parent or guardian.

Products, descriptions and images

We take care to describe products accurately. Product images are for representation — minor variation in colour, finish or packaging may occur. Where a product materially differs from its description, you're entitled to a replacement or refund under our Returns & Cancellation policy.

Pricing

All prices are in Indian Rupees and inclusive of GST unless stated otherwise. The total payable — including delivery charges and taxes — is shown before you confirm your order. Any strike-through price shown is the manufacturer's recommended retail price or our own previously listed price, and is not a representation about prices charged by any other seller. If a product is listed at an incorrect price due to a technical or human error, we reserve the right to cancel the order and issue a full refund; we'll tell you before doing so.

Orders

Your order is an offer to purchase. A contract forms only when we confirm dispatch. We may decline or cancel an order where the product is out of stock, your pincode isn't serviceable, there's a pricing or listing error, we suspect fraud, or we can't verify a Cash on Delivery order. In each case you receive a full refund of anything paid.

Payment

We accept UPI, cards, net banking and wallets through Razorpay, and Cash on Delivery on eligible pincodes and order values. We don't store your card or banking credentials. A GST invoice is issued for every order.

Delivery

Delivery estimates provided by our courier partners are estimates, not guarantees; full details are in our Shipping Policy. Where delivery is delayed beyond the stated schedule for reasons other than a force majeure event, you may cancel and receive a full refund, in line with the Consumer Protection (E-Commerce) Rules, 2020. Risk in the goods passes to you on delivery.

Returns, cancellation and warranty

Governed by our Returns & Cancellation policy, which forms part of these Terms. In summary: cancellation is free before dispatch, and eligible claims for damaged, defective, wrong, missing or misdescribed items may be raised within 7 days of delivery. Selected products carry a 30-day limited warranty, stated on the product page.

Acceptable use

You agree not to use this website to breach any law, infringe intellectual property, introduce malware or gain unauthorised access, scrape or harvest content by automated means, place fraudulent orders or repeatedly refuse Cash on Delivery parcels, or post unlawful, defamatory, obscene or misleading content. We may suspend access where we reasonably believe these Terms have been breached.

Intellectual property

All content on this website — including the Culture Nest name, logo, text, graphics, product photography, layout and code — is owned by or licensed to us and protected under the Copyright Act, 1957 and the Trade Marks Act, 1999. You may not reproduce, distribute or commercially exploit any of it without our written permission.

Reviews and user content

By submitting a review or other content, you grant us a non-exclusive, royalty-free licence to use, display and reproduce it in connection with our business. You confirm your content is your own, honest, and doesn't infringe anyone's rights. We may remove content that's unlawful, offensive, misleading or not a genuine account of a purchase. We do not publish fake reviews and we do not remove genuine negative reviews.

Third-party services

We rely on third parties including Shopify, Razorpay and Delhivery. Their services are governed by their own terms. We're not liable for failures or delays caused by third-party service providers, beyond our obligations under this agreement and applicable consumer law.

Limitation of liability

To the extent permitted by law, our total liability for any claim arising from an order is limited to the amount you paid for that order. We're not liable for indirect or consequential loss. Nothing in this clause limits or excludes any liability that cannot be limited or excluded under the Consumer Protection Act, 2019 or other applicable law, including liability for defective goods or deficient service.

Force majeure

We're not liable for failure or delay in performing our obligations due to events beyond our reasonable control, including natural disasters, pandemics, strikes, riots, government restrictions, courier network failures, or internet and power outages.

Your rights are preserved

Nothing in these Terms limits or excludes your rights under the Consumer Protection Act, 2019. We will not refuse to take back goods, or refuse a refund, where goods are defective, deficient, spurious, not as advertised, or delivered later than the stated schedule.

Governing law and jurisdiction

These Terms are governed by the laws of India. Disputes are subject to the jurisdiction of the courts at Kolkata, West Bengal — without prejudice to a consumer's right to approach the Consumer Disputes Redressal Commission having jurisdiction over their own place of residence.
